1. Acceptance of Terms
By accessing and using the services of B Mark Business Solutions (“Company,” “we,” “our,” or “us”), you accept and agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our services. These terms constitute a legally binding agreement between you and the Company, enforceable under the laws of Pakistan.
2. Services Offered
B Mark Business Solutions provides the following services:
- Food safety training and certification programs (ISO 22000, FSSC 22000, BRCGS, HACCP, etc.)
- Food safety consulting and implementation services
- Internal and external audit services
- Documentation and system development
- Gap analysis and compliance assessments
- Laboratory coordination and testing guidance
3. Training Programs
- 3.1 Registration and Payment
- All training registrations must be completed with accurate information
- Payment must be made in full before the training start date unless otherwise agreed in writing
- Accepted payment methods include bank transfer, cheque, and online payment (subject to availability)
- All prices are quoted in Pakistani Rupees (PKR) unless otherwise specified
- Prices are exclusive of applicable taxes unless stated otherwise
- 3.2 Cancellation and Refund Policy
- Cancellations made 14 days or more before the training date: Full refund minus PKR 5,000 administrative fee
- Cancellations made 7-13 days before: 50% refund
- Cancellations made less than 7 days before: No refund
- Participants may transfer registration to another person at no additional cost with 48 hours notice
- The Company reserves the right to cancel or reschedule training programs with full refund to participants
- 3.3 Attendance and Certification
- Minimum 90% attendance is required to be eligible for certification
- Participants must pass the required examination (where applicable) to receive certification
- Certificates are issued within 14 working days of successful course completion
- Duplicate certificates may be issued upon request for an additional fee of PKR 3,000
4. Consulting Services
- 4.1 Scope of Work
All consulting engagements will be governed by a separate Service Agreement that outlines the specific scope of work, deliverables, timeline, and fees. These Terms and Conditions shall apply in addition to any Service Agreement.
- 4.2 Client Responsibilities
- Provide accurate and complete information necessary for the consulting engagement
- Grant reasonable access to facilities, personnel, and documentation
- Assign a dedicated point of contact for the project
- Make timely decisions to avoid project delays
- 4.3 Confidentiality
We maintain strict confidentiality of all client information. Information shared during consulting engagements will not be disclosed to third parties without written consent, except as required by law.
5. Intellectual Property
All training materials, documentation, templates, and content provided by B Mark Business Solutions are protected by intellectual property laws. You may not:
- Reproduce, distribute, or share training materials without written permission
- Use our materials for commercial purposes or to train others
- Remove or alter any proprietary notices or labels
- Create derivative works based on our materials
6. Limitation of Liability
To the maximum extent permitted by Pakistani law:
- Our total liability for any claim shall not exceed the fees paid for the specific service giving rise to the claim
- We shall not be liable for any indirect, incidental, special, consequential, or punitive damages
- We do not guarantee certification outcomes by third-party certification bodies
- Our consulting services are advisory in nature; final decisions and implementation remain the client’s responsibility
7. Disclaimer of Warranties
Our services are provided “as is” and “as available.” While we strive for excellence, we make no warranties, express or implied, regarding the merchantability, fitness for a particular purpose, or non-infringement of our services. Certification outcomes depend on various factors including client implementation and auditor assessment.
8. Force Majeure
Neither party shall be liable for delays or failures in performance resulting from circumstances beyond reasonable control, including but not limited to natural disasters, acts of God, government actions, epidemics, pandemics, civil unrest, or infrastructure failures. In such events, affected obligations will be suspended for the duration of the force majeure event.
9. Indemnification
You agree to indemnify and hold harmless B Mark Business Solutions, its directors, employees, and agents from any claims, damages, losses, or expenses arising from your breach of these Terms, misuse of our services, or violation of any applicable laws.
10. Website Use
When using our website, you agree not to:
- Use the website for any unlawful purpose
- Attempt to gain unauthorized access to any systems or data
- Transmit any viruses, malware, or harmful code
- Interfere with the proper functioning of the website
- Collect user information without consent
11. Dispute Resolution
- 11.1 Negotiation
Any dispute arising from these Terms shall first be attempted to be resolved through good faith negotiations between the parties.
- 11.2 Arbitration
If negotiation fails, disputes shall be resolved through arbitration in accordance with the Arbitration Act, 1940 of Pakistan. The arbitration shall be conducted in Lahore, Pakistan, in the English or Urdu language.
- 11.3 Jurisdiction
The courts of Lahore, Pakistan shall have exclusive jurisdiction over any legal proceedings arising from these Terms.
12. Modifications to Terms
We reserve the right to modify these Terms and Conditions at any time. Changes will be effective upon posting to our website. Your continued use of our services after any modifications constitutes acceptance of the updated terms. We encourage you to review these Terms periodically.
13. Severability
If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
14. Entire Agreement
These Terms and Conditions, together with our Privacy Policy and any Service Agreements, constitute the entire agreement between you and B Mark Business Solutions regarding the use of our services.

16. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of the Islamic Republic of Pakistan, including the Contract Act 1872, Sale of Goods Act 1930, and any other applicable legislation.
